Terms of Service

Please read carefully before using our services

Terms of Service Revised on August 8, 2023

Preface

  1. To provide high-quality and stable services to customers, and to establish a clear basis for dispute resolution, these Terms of Service are formulated.
  2. When purchasing services or products, you must agree to these Terms of Service. If you have already purchased services or products and completed payment, you are deemed to have agreed to these Terms of Service.
  3. Users have the rights specified in these Terms of Service and must fulfill the obligations outlined in these terms. Disputes between users and WePC regarding the use of products and services will be handled in accordance with these terms.
  4. WePC reserves the final right to interpret this User Service Agreement.

Usage Terms

  1. Servers sold by WePC do not include data security guarantees. Even servers using RAID10 plus BBU architecture do not include data security guarantees, and WePC cannot compensate users for the value of their data.
  2. The use of tools that harm the security of telecommunications operators' networks is prohibited on WePC server products.
  3. To ensure stable network packet transmission, tools that send excessive or abnormal packets, as well as activities that continuously occupy a large amount of bandwidth, are prohibited.
  4. It is prohibited to store, provide, or publish content that violates the laws of the server location or applicable laws in the product services provided by WePC.
  5. Reselling WePC services or products for personal or business use without authorization is prohibited.
  6. Running software or services that consume excessive CPU, bandwidth, disk, or network resources is prohibited. This includes, but is not limited to, traffic mining, CDN services, public proxies, virtual currency mining, video挂机, cluster computing, PT services, traffic exchange, scraping, and similar activities.
  7. The use of BT software, including BT, Thunder, uTorrent, and similar tools, is prohibited.
  8. It is prohibited to send malicious packets externally or internally, perform DDoS attacks, ARP attacks, ARP hijacking, weak password scanning, malicious enumeration, spam messaging, junk mail sending, or any activity that interferes with the normal operation of other servers.
  9. When using WePC products and services, users must comply with the laws of Australia and the laws of the server location.
  10. WePC only guarantees the normal operation of the products and services sold and provided. WePC has no obligation to assist with software configuration, software errors, or user-side application issues.
  11. Users must reasonably use the support ticket system, respect customer service staff, and must not abuse customer service, submit meaningless tickets, continuously harass support staff, or otherwise interfere with normal support operations. WePC reserves all legal rights in the event of malicious damage to WePC's reputation.
  12. Nested virtualization is prohibited for all server series except dedicated servers.
  13. Users must not place promotional links on websites they do not own. Once discovered, WePC may refuse to pay promotional fees and close the promotional link account.
  14. HK_3CMI services are non-refundable.
  15. If any of the above prohibited behaviors are discovered, WePC has the right to terminate the service immediately without refund. Added on June 20, 2022.

Cloud Server IPv4 Address Replacement

  1. Cloud server IPv4 addresses may be purchased as additional products and replaced after purchase. If automatic replacement is not available, please submit a support ticket.
  2. Cloud server IPv4 addresses may be changed for a fee. The charge is AUD $5.00 per change. Each VPS may change its IP address no more than twice per month.
  3. If you require a specific IP address range, please contact our sales team for a solution.
  4. If the IPv4 address is still blocked after replacement, you may submit a support ticket within 24 hours to request manual replacement. If more than 24 hours have passed, the IP replacement will be considered complete.
  5. If a large number of IP addresses are blocked during special periods, WePC reserves the right to temporarily adjust pricing.
  6. If an IPv4 address is blocked in certain countries or regions during the rental period due to the user's own usage, WePC may charge an IPv4 address property loss fee depending on the situation.

Fault Compensation

  1. Failures caused by data center routing equipment, power equipment, upstream providers, or infrastructure outside WePC's direct control are not eligible for compensation.
  2. Failures caused by natural disasters, force majeure, social events, government action, network attacks, or other factors beyond our control are not eligible for compensation.
  3. Failures caused by WePC may be compensated according to a 1:2 compensation standard. If the fault duration is less than 24 hours, it will be calculated as 24 hours.
  4. Compensation will be issued within 3 to 5 days after the fault is restored. The product must be in valid and active operation to be eligible for compensation.

Cloud Server Transfer Instructions

  1. The initial activation security period for transfers is 3 days, and transfers cannot be manually initiated earlier.
  2. The transfer fee is AUD $2.50 per transfer. The minimum charge for each transfer is AUD $2.50.
  3. The remaining available duration of transferable products must be greater than: monthly products - 15 days; annual, biennial, and triennial products - 60 days.

Refund Guarantee and Payment Dispute Policy

The refund policy is as follows:

  1. For transactions within 3 days and under 10GB of data usage, with an individual amount of RMB 50 or less, a full refund may be issued to the account balance. Account balance is non-withdrawable.
  2. For transactions within 3 days and under 10GB of data usage, with an individual amount over RMB 50, a full refund may be issued to the account balance, or refunded through the original payment method or to a customer-specified account after deducting applicable fees.
  3. Products used for more than 3 days are generally not eligible for refund without special reasons. Where an exception is approved, the refund may be calculated by deducting 6% per day and returning the remaining amount to the account balance.
  4. Products marked as non-refundable are not eligible for refund unless there are irreparable routing changes or machine failures that cause service unavailability or materially reduced usability. In such cases, the remaining product value may be refunded to account balance or returned through the original payment method or a customer-specified account.
  5. No refund will be provided if the user violates these Terms of Service.
  6. No refund will be provided if the user's behavior materially affects other users, WePC servers, or normal service operation.
  7. No refund will be provided if the service has used more than 10GB of traffic, as determined by backend traffic statistics.
  8. No refund will be provided if the assigned IP address is blocked by the GFW or by national, regional, or governmental authorities.
  9. No refund will be provided for products purchased through promotions or discount codes unless otherwise stated.
  10. Presale products in the Running or Active state are not eligible for refund.
  11. Three or more refund requests in one day may be regarded as malicious consumption, and WePC has the right to suspend the account.
  12. More than five refund cancellations under one account may be regarded as malicious consumption, and WePC has the right to suspend the account.
  13. Registering multiple accounts and requesting repeated refunds may result in account suspension.
  14. Machines that have already had their IP address changed are not eligible for refund. Products clearly marked as non-refundable on the purchase page are not eligible for refund.

Disclaimer

  1. WePC is not responsible for service inaccessibility or data loss caused by user non-payment, failure to renew, or forgetting to renew.
  2. WePC is not responsible for service inaccessibility or data loss caused by the user's improper operation or related behavior.
  3. WePC is not responsible for service inaccessibility or data loss caused by the user's website content or actions that violate these Terms of Service or Usage Terms.
  4. WePC is not responsible for service inaccessibility or data loss caused by uncontrollable social, natural, governmental, network, or force majeure factors.
  5. WePC is not responsible for service inaccessibility or data loss caused by the user's self-installed ISO operating system, DD operation, or similar system-level operations.

Reserved Rights

  4. 禁止在 WePC 提供的产品和服务中存储、提供或发布违反服务器所在地法律或其他适用法律的内容。
  5. 禁止未经授权将 WePC 的服务或产品用于个人或商业转售。
  6. 禁止运行消耗大量 CPU、带宽、磁盘或网络资源的软件或服务,包括但不限于流量挖矿、CDN、公共代理、各种虚拟货币挖矿、视频挂机、集群计算、PT 服务、流量交换、抓取以及类似行为。
  7. 禁止使用 BT、迅雷、uTorrent 及类似 BT 软件。
  8. 禁止在使用服务器时向外部或内部发送恶意数据包,进行 DDoS 攻击、ARP 攻击、ARP 劫持、弱密码扫描、恶意枚举、发送垃圾短信、垃圾邮件,或干扰其他服务器正常运行。
  9. 使用 WePC 产品和服务时,必须遵守澳大利亚法律以及服务器所在地法律。
  10. WePC 仅保证所售和提供的产品及服务的正常运行。WePC 没有义务协助解决用户软件配置、软件错误或用户侧应用问题。
  11. 用户应合理使用支持工单系统,尊重客户服务人员,不得滥用客户服务、提交无意义工单、持续骚扰或纠缠客服人员,或以其他方式干扰正常支持秩序。对于恶意损害 WePC 声誉的行为,WePC 保留采取相应措施及追究法律责任的权利。
  12. 除专用服务器以外,所有服务器系列均禁止进行虚拟化嵌套。
  13. 不得在非自有网站上放置推广链接。一经发现,WePC 有权拒绝支付推广费用并关闭推广链接账户。
  14. 以上禁止行为一经发现,WePC 有权立即终止服务并不予退款。本条于 2023 年 6 月 20 日新增。

云服务器 IPv4 地址更换

  1. 云服务器 IPv4 地址可作为附加产品购买,购买后可进行更换。如暂不支持自动更换,请提交支持工单处理。
  2. 云服务器 IPv4 地址可付费更换,费用为每次 3.50 至 5.00 澳元。同一台机器每个月更换 IP 不得超过两次。
  3. 如果您需要特定 IP 地址范围,请联系销售团队获取解决方案。
  4. 如果 IPv4 地址更换后仍被封锁,您可以在 24 小时内提交支持工单申请免费人工更换。超过 24 小时后,IP 更换将被视为完成。
  5. 如果在特定时期出现大量 IP 地址被封锁的情况,WePC 保留临时调整价格的权利。
  6. 如果设备租赁期间 IPv4 地址因用户自身使用原因导致在某些国家或地区被封锁,WePC 可能会根据实际情况收取 IPv4 地址财产损失费用。

故障赔偿

  1. 由数据中心路由设备、电源设备、上游服务商或 WePC 无法直接控制的基础设施造成的故障,不予赔偿。
  2. 由自然灾害、不可抗力、社会事件、政府行为、网络攻击或其他我们无法控制的因素造成的故障,不予赔偿。
  3. 由 WePC 原因造成的故障,可按照 1:2 的赔偿标准进行赔偿;不足 24 小时的,按 24 小时计算。
  4. 故障恢复后,赔偿将在 3 至 5 天内发放。产品必须处于有效运行状态,才具备赔偿资格。

云服务器转移说明

  1. 转移的初始激活安全期为 3 天,在此之前不能手动发起转移。
  2. 每次转移费用为 2.50 澳元。每次转移最低收费为 2.50 澳元。
  3. 可转移产品的剩余可用期限必须大于:月付产品 15 天;年付、两年付、三年付产品 60 天。

退款保证和支付拒绝争议

退款政策如下:

  1. 3 天内且使用流量低于 10GB,单笔金额为人民币 50 元及以下的交易,可全额退款至账户余额,账户余额不可提现。
  2. 3 天内且使用流量低于 10GB,单笔金额超过人民币 50 元的交易,可全额退款至账户余额,或在扣除相应手续费后原路退回或退回客户指定账户。
  3. 使用超过 3 天的产品,如无特殊原因,不享受退款服务。如经批准存在特殊原因,可按每天扣除 6% 的计算方式将剩余金额退回账户余额。
  4. 无退款承诺产品,除非因无法修复的路由改变或机器故障导致无法使用或可用性明显降低,否则不予退款。符合条件时,可按产品剩余价值退回账户余额,或原路退回支付账户,或退回客户指定账户。
  5. 违反本服务条款列明内容的,不予退款。
  6. 用户行为明显影响其他用户正常使用、WePC 服务器正常运行或服务秩序的,不予退款。
  7. 使用流量超过 10GB 的,不予退款,流量以后台统计为准。
  8. 所分配 IP 地址被 GFW 或国家、地区、政府机构封锁的,不予退款。
  9. 参与促销活动或使用折扣代码购买的产品,除非另有说明,不予退款。
  10. 预售产品处于 Running 或 Active 状态的,不予退款。
  11. 一天内提出三次或以上退款请求,可能被视为恶意消费,WePC 有权暂停账户。
  12. 同一账户通过退款取消超过五次服务,可能被视为恶意消费,WePC 有权暂停账户。
  13. 注册多个账户并反复请求退款的,可能导致账户被暂停。
  14. 已经更换过 IP 的机器不享受退款服务;购买页面明确标注不退款的产品,不提供退款服务。

免责声明

  1. 因用户未付款、未续费或忘记续费导致的服务不可访问或数据丢失,WePC 不承担责任。
  2. 因用户不当操作或其他相关行为导致的服务不可访问或数据丢失,WePC 不承担责任。
  3. 因用户网站内容、用户行为或违反本服务条款、使用条款导致的服务不可访问或数据丢失,WePC 不承担责任。
  4. 因不可控的社会、自然、政府、网络或不可抗力因素导致的服务不可访问或数据丢失,WePC 不承担责任。
  5. 因用户自行 ISO 安装操作系统、DD 操作或类似系统级操作导致的服务不可访问或数据丢失,WePC 不承担责任。

保留权利

  1. WePC 保留对本服务条款的最终解释权。
  2. WePC 保留随时修改本服务条款且无需另行通知的权利。
